Wife on Trial for Orchestrating Millionaire Husband's Murder

As it grew dark, 87-year-old Bernice Novack decided to move her car into her garage. That was when Alejandro Garcia, who’d been hiding behind garbage cans near her driveway, says he snuck up behind her.

“She looked at me and right away I hit her,” Garcia told a jury, speaking through a Spanish interpreter. “She looked at me and she screamed.”

The dramatic testimony by the prosecution’s star witness came in a sensational trial now underway in White Plains, N.Y., for the 2009 murders of Novack and her millionaire son Ben Novack Jr., once the owner of Miami Beach’s storied Fountainbleau Hotel.

The Alleged Motive

Amid allegations of jealousy, betrayal and greed, Ben’s wife Narcy Novack, a former stripper from Ecuador, stands accused of joining forces with her brother to arrange both murders.

The alleged motive: Narcy wanted her husband dead because she knew he was having an affair with a former $300-an-hour call girl and feared he’d divorce her, leaving her broke because of their prenuptial agreement. His will left millions to her.

Two admitted hit men, including Garcia, have pleaded guilty and are testifying for the prosecution.

With its tawdry revelations and moneyed players, the case revealed a dark side to the glitz and glamour surrounding the Fountainbleau, owned by Ben Jr.’s father before him. Ben Jr. grew up there, rubbing elbows with the likes of Frank Sinatra and Elvis Presley.

But the trial is also intensely personal for close friends and family, no more so than for Maxine Fiel – Bernice’s sister and Ben Jr.’s aunt.

Fiel refused to believe police’s initial finding that Bernice’s death was from a series of accidental falls. She pushed investigators and the medical examiner, even questioning witnesses herself, until they finally reclassified it as a homicide in July 2010.

“I hope she [Narcy] never sees the light of day,” Fiel, 88, tells PEOPLE. “Women’s jails aren’t easy. She’ll get justice there. Bernice must have been frightened to death. What an end to her life. Mother and son brutally murdered. This is a horrible woman. Horrible.”

Grew Up Amid Glamor

Ben Jr.’s ties to the Fontainebleau Hotel ended with bankruptcy in 1977. He went on to run a successful events-planning company in Florida. A few years later he met Narcy and they wed in 1991. It was a stormy marriage: Ben Jr. filed for divorce at one point, but rescinded after they reconciled.

In 2008, Ben Jr. answered an online ad placed by a porn actress named Rebecca Bliss, working at the time as a high-priced prostitute. Bliss, 40, of Fort Lauderdale, Fla., testified that they began a love affair and that Ben Jr. was going to leave his wife.

She said Narcy got wind of the affair and in early 2009 offered her $10,000 to end it.

“She said that if she couldn’t have him, no other woman was going to have him,” Bliss said on the stand under questioning by Assistant U.S. Attorney Andrew Dember.

Narcy, 54, responded by hatching a plot along with her brother Cristobal Veliz, 57, prosecutors allege. Veliz allegedly recruited two men from a Miami car wash to help with their scheme – Garcia, 34, and Joel Gonzalez, 27.

In April 2009, Garcia beat Bernice Novack to death with a monkey wrench at her Fort Lauderdale home, Garcia said.

Three months later, while on a business trip to Rye Brooke, N.Y., Ben Jr. was beaten so brutally by Garcia that 20 of his ribs were cracked, his head was bashed in and his mouth was taped so tightly that he choked, authorities said. His eyes were gouged out as well.

Narcy helped muffle her husband’s screams with a pillow, Garcia testified. Gonzalez helped Garcia kill Ben Jr., according to prosecutors.

“It was a personal killing,” Westchester County prosecutor Perry Perrone told jurors in opening arguments. “It was a sadistic killing.”
The Defense Case

Narcy and her brother are charged with racketeering and other offenses for arranging both those murders. Defense attorneys have pointed the finger at Narcy’s own daughter, Maya Abad, 36, in their opening arguments, saying she framed her mother.

“(Abad’s) going to get everything, ” said Howard Tanner, Narcy’s lawyer. “Her kids are going to get everything. There’s only one person standing in her way. That’s Narcy Novack.”

Abad, who went into hiding with her teen-aged sons after the murders due to death threats, told the Miami Herald she wasn’t surprised her mother is trying to blame her.

“This whole thing is a joke,” she told the Miami Herald. “To me, they are going to say whatever they can to save their own asses.”

Howard Stern Shows Heart on America's Got Talent

Howard Stern is in the building!

The radio shock jock took his seat next to Sharon Osbourne and Howie Mandel on America’s Got Talent Monday night during the show’s seventh season premiere.

“These executives at NBC must be out of their mind to take a risk on me,” he said at the top of the hour. But in fact, Stern showed a lot of heart and proved he’s got talent – for judging!

When the Light Wire Theater group performed a dance routine featuring glow-in-the-dark dinosaurs, Stern, who pointed out earlier in the night that he was the only American on the panel, had a moment of patriotism. “We are the greatest country in the world. We have the most creative people. You’re everything that makes America great,” he told the dancers. “I applaud your originality and I thank you for lifting everyone’s spirit.”

Watching father and daughter duo Maurice and Shanice Hayes sing “I’ll Be There” made the new judge emotional. “You move me. You guys are spectacular together,” he said. “I think every father in America right now is like, ‘Wow, that’s the kind of relationship I want to have with my daughter.’ ”

But Stern hasn’t totally lost his edge. When stripping magician Aoni Jackson made Howie Mandel’s ring disappear and then reappear hanging off Jackson’s nipple ring, Stern buzzed him not once but twice, walking over to Howie’s empty seat and lighting up his X for him.

“I think the X has a lot of power,” he said later. “I like hitting it.”

When another performer with questionable talents said his parents were dead, Stern asked if they died of embarrassment.

A longtime fan of the show, Stern is clearly enjoying himself as the newest judge – and it’s a refreshing change for NBC’s summer talent search.

“It is one of the most fun experiences I’ve ever had in my life,” he said.

Dancing with the Stars Drama: An Emotional Meltdown & Perfect Scores

Dancing with the Stars Drama: An Emotional Meltdown & Perfect Scores | Brooke Burke, Tom Bergeron

With the competition down its fierce final days, and perfect 10s flying in the ballroom, the pressure at Dancing with the Stars finally took its toll on one leading contender.

A seemingly minor misstep at the end of a solid-scoring routine left this contestant in tears Monday night in one of the most dramatic moments of the season.

Read on for more …

At the end of a glorious salsa – their second routine – Katherine Jenkins seemed to stumble, a mistake that barely troubled judges, who awarded a trio of nines to the singer and dancing pro Mark Ballas.

“That was just fantastic,” said Carrie Ann Inaba. “I’m sorry at the end. But I just love seeing you push your boundaries.”

But with the finals a week away and the remaining contestants so evenly matched, the miscue left Jenkins in tears. “I’m sorry, Mark,” she told her partner.

It was unclear whether she was crying out of disappointment – or pain – for it was a step down from the previous dance, a quickstep, that picked up a pair of 10s and a nine for a nearly perfect 29.

After the tango, Jenkins could be heard saying, “I don’t know what happened.” She later Tweeted: “I’m with the Doctor, he says it was a reflectorical spasm in my lower back.”

Only a razor’s edge in scoring separated them from the other contestants on a night that saw literal perfection in the scoring. “This is going to be the best semi-finals ever,” proclaimed Len Goodman.

Maria Menounos and Derek Hough could not have done a better tango, getting yet another perfect 30 and leaving even the excitable Bruno Tonioli grasping for superlatives: “Titillating, enticing … absolutely fabulous.” Later they got a 29 for their jive.

William Levy and Cheryl Burke matched that 30 for a red-hot samba that had the usually reserved Goodman gushing, “I’ve never looked at a man’s bum for so long in my life.” (Their earlier tango collected 29 points).

And Donald Driver and Peta Murgatroyd soared, getting 10s from Tonioli and Inaba and a nine from Goodman for the samba. “I just thought that was A-plus,” said Inaba. This topped their 28-point tango earlier.

Jessica Sanchez was greeted with open arms when she returned to Chula Vista, Calif., for American Idol’s hometown heroes week.

Cheered by thousands of fans, the finalist waved as she rode through town in a car with her two little brothers into Eastlake High School’s stadium on Saturday.

“I feel amazing,” Sanchez, 16, said as she made her way to the stadium’s stage. “I’m so happy to represent Chula Vista. It was the people. I missed the people so much. I love you guys. Thank you for all the support.”

With the town’s mayor declaring May 12 as “Jessica Sanchez Day,” the singer sang four songs, including Whitney Houston’s “I Will Always Love You.”

But it was one of her following performances at the USS Midway Museum that turned emotional. Sanchez invited her dad on stage to sang a rendition of Luther Vandross’s “Dance with My Father.” Her dad, a member of the U.S. Navy, is being deployed to Singapore.

Meanwhile, in other parts of the country, fellow finalists Joshua Ledet and Phillip Phillips also headed home to film segments that will be featured on Wednesday’s episode of Idol.

• In Westlake, La., just outside of Lake Charles, Ledet was greeted with signs that covered every business. Honored with a parade and a pep rally at Burton Coliseum nearby, the contestant was swarmed by fans kissing his hand and reaching to touch him.

• In South Georgia, guitar-strumming singer Phillips performed for thousands of his local fans at Lee County High School.

“I don’t even know what to say but thank you,” Phillips said during the appearance. “I appreciate all of the support.”

Given a key to the city, Phillips, like Sanchez, had the day declared as his own.

Meanwhile, Roshon Fegan and Chelsie Hightower improved from last week with a 25-point tango.
